Staff recommends that Council conduct the public hearing, and unless evidence to the contrary is introduced, adopt Resolution 10-2022 making the finding of Eligibility for the Annexation of Sierra Vista Addition No. 2 is eligible for annexation.

Upon finding the subject property is eligible for annexation, the next step is consideration of an ordinance annexing the property to the municipal boundary of Alamosa. Nothing about the finding of eligibility commits the City to adopting the annexation ordinance. Eligibility is merely a function of determining the 1/6 (16.66%) contiguity requirement is met, as well as the other matters concerning urbanization, etc, set forth in the Resolution.
Staff has determined that the area has 40.19% contiguity. A copy of the annexation plat is attached. |

Council can approve the Resolution based on evidence in the record and move forward with the consideration of the Public Hearing on Resolution No. 10-2022, finding of Eligibility for the Sierra Vista Addition No. 2 Annexation or find, on evidence, that the area is not eligible for annexation for failure to meet one or more of the conditions set forth in the Resolution.

There is no fiscal impact from a finding of eligibility. Fiscal impacts of the annexation itself are addressed later in the process when Council determines whether and on what conditions it will proceed with annexation.

A finding of eligibility is a necessary step to continuing with the annexation process. The subject property appears to be eligible. |
